H2B Cap Is Reached for Second Half of 2008

USCIS announced that a sufficient number of H2B filings have been received for the second half of Fiscal Year 2008. The news hit us all hard, both lawyers and employers will need to struggle to keep workers on the job and the business going. I urge employers to write to their elected officials to take action and save our economy before it is too late.

The H2B category is a great option for certain seasonal or temporary workers in occupational areas such as construction, hospitality, landscaping, entertainment, manufacturing, food service / processing, and resort services. Because the cap has already been reached for the second half of FY2008, this opportunity has now closed until FY2009, which begins October 1, 2008. Employers will need to consider other options like the H3 or J1 visas.
