Israeli Investors Now Eligible for E-2 Visa Program

The U.S. Embassy in Israel recently announced Israel’s participation in the E-2 Treaty Trader Visa program. Beginning May 1st, Israeli citizens can apply for the E-2 Investor Visa to invest in a new or existing business in the United States.

What is the E-2 Visa?

The E-2 Investor Visa program allows foreign nationals from treaty nations that have an agreement of commerce and navigation with the U.S., to travel to the United States for a temporary period of time for purposes of investment in a new or existing business venture. To qualify for this visa classification the treater investor must invest a substantial amount of capital in the business. The amount of capital to be invested depends on the type of business the investor is planning to undertake.

As indicated, Israel has now been added to the countries participating in the E-2 visa program.

Applying Within the U.S.

If you are currently in the United States in lawful nonimmigrant status such as H-1B or B-1, you may file Form I-129 to request a change of status to E-2 classification. 

Applying Outside the U.S.

If you are outside of the United States, you may apply for the E-2 visa classification at the U.S. Embassy in Tel Aviv. Our office can assist you in preparing your E-2 visa application and prepare you for the interview. Upon issuance of the E-2 visa, you may enter the United States as a treaty investor.

The Investment Must be at Risk

An investment in the trade or business must be considered at risk meaning that the capital must be at risk of being partially or totally lost. This demonstrates the investor’s commitment to the business venture. In addition, a treaty investor must prove that the investment funds that will be used have not been obtained directly or indirectly from criminal activity.
